Defending Aggravated Burglary
Aggravated Burglary (Section 10) is committed if you commit a burglary while in possession of a firearm, imitation firearm, weapon of offence, or explosive. The sentence can be Life Imprisonment. Prosecution is aggressive and unforgiving.
Our defence strategy is forensic. You must have the weapon *with you* at the time of the burglary. If the weapon was picked up inside the property during a struggle (instant arming), the charge may not stick. We also challenge the classification of the item—is a screwdriver a weapon or a tool for entry? These distinctions make the difference between years in prison and a lighter sentence.

If you were with a group and didn't know someone else had a weapon, you should not be convicted of the aggravated offence. We aggressively defend against this 'imputed knowledge', using case law to protect you from the actions of co-defendants.
We also scrutinise the 'trespass' element. If you were invited in, it is not burglary, regardless of what happened inside (though other charges may apply).
