Firearm Possession

Understand Your Situation

Firearms law is complex and carries mandatory minimum sentences. We provide the technical expertise required to navigate these dangerous legal waters.

Expert Defence for Gun Possession Charges

The UK has some of the strictest gun laws in the world. Merely possessing a prohibited weapon (like a handgun or sawn-off shotgun) can trigger a mandatory 5-year prison sentence. However, the law is complex, and the classification of the 'weapon' is often open to challenge.

We work with ballistics experts to verify if the item actually falls under the prohibited categories. We also explore statutory defences and 'exceptional circumstances' that can persuade a judge to waive the mandatory minimum sentence. Whether it is an antique, a misunderstanding, or a frame-up, we fight your corner.

Plan Your Defence

The Firearms Act and Mandatory Minimums

Most serious charges fall under *Section 5 of the Firearms Act 1968*. Possession of a Section 5 firearm carries a mandatory minimum term of 5 years for adults, unless 'exceptional circumstances' are found (*R v Rehman*).

We meticulously examine the classification of the firearm (e.g., is it an antique? Is it deactivated properly?). We also investigate the concept of 'possession'—knowledge and control are required. If the item was planted or you were unaware of its presence, we build a defence based on lack of knowledge (*Warner v Metropolitan Police Commissioner*).
