Defending Hate Crime Allegations
A Hate Crime is any criminal offence (assault, harassment, criminal damage) which is perceived to be motivated by hostility towards race, religion, disability, or sexual orientation. This leads to 'Racially/Religiously Aggravated' charges which carry higher sentences.
We challenge the evidence of hostility. Often, a generic insult is recorded by police as a hate crime. We cross-examine witnesses to prove that the incident was not motivated by prejudice. If we can remove the 'aggravated' element, the charge reverts to the basic offence (e.g., Common Assault instead of Racially Aggravated Assault), significantly reducing the penalty.
