Defending Category B Charges
Category B includes non-penetrative but explicit sexual activity. The sentencing guidelines are lower than Category A, but a custodial threshold remains.
We focus on the 'accessibility' of the images. Were they in a deleted folder? Were they thumbnails? If the images were not accessible or you had tried to delete them, this goes to your lack of current intent. We also rigorously defend against 'Distribution' charges—proving that file-sharing software (P2P) may have operated without your active knowledge is a key technical defence.
