Voluntary vs Involuntary

**Voluntary Manslaughter:** Occurs when the defendant kills with intent (mens rea for murder) but has a partial defence such as *Loss of Control* or *Diminished Responsibility*.

**Involuntary Manslaughter:** Usually 'Unlawful Act Manslaughter' or 'Gross Negligence'. For Unlawful Act, the prosecution must prove the defendant committed an intentionally unlawful and dangerous act that caused death (*R v Church*). We focus on breaking the 'chain of causation' or proving the act was not objectively dangerous.
